Welcome to Photographs Restored (herein referred to as "we", "us", or “Photographs Restored”). We hope you enjoy your visit.

 

Your use of Photographs Restored’s website/services constitutes your agreement to these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use Photographs Restored’s website/services.

 

Photographs Restored has the right to suspend or refuse any and all current or future use of our services.

 

We reserve the right to change your terms, rates and fees at any time, for any reason.

 

Photographs Restored will report any unlawful use or abuse of its system to authorities and will prosecute unlawful conduct (including threats thereof) to the fullest extent of the law.

 

IMPORTANT NOTE ABOUT COPYRIGHT LAW: Sending a file to us constitutes an AGREEMENT by you that you are familiar with the copyright laws, and you agree to defend and indemnify us from all expenses and liability arising from our performing the requested activities at your request, regardless of legal theory, including violation of statute, our negligence, your breach of this agreement, or otherwise.

 

Photographs Restored will not be liable for any damages of any kind arising from the use of this site and/or our services.

 

You may not use a false e-mail address, impersonate any person or entity.

 

You agree to not use our services to upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another´s privacy, hateful, or racially, ethnically or otherwise objectionable.

 

You understand and agree that the download or upload of any material through our systems is done at your own discretion and risk and that you will be solely responsible for any loss or damage to your files, and any damage to your computer system or loss of data that may result in the download or upload of any material.

 

You agree that all billing or shipping information that you submit is accurate.

 

We provide a restored digital file. Prints can be ordered for an additional charge.

 

Please always review order prior confirmation carefully. If you notice an error, your order can only be cancelled within the first 30 minutes of placing the order. After the 30-minute period is over, your order will be processed and can no longer be cancelled.

 

The best moment to ask for a RUSH service is when placing the order. Due to technical reasons it might not be always possible to RUSH an order once it is "In Process".

 

About Instructions, Re-works and/or Refunds

 

Photographs Restored will perform its Customers´ clear and complete instructions. Orders will be restored following their "as submitted" instructions and Customer is fully responsible for final verification and approval prior to submission to the restoration process. Once you submit an order to the restoration process you are agreeing that you are fully satisfied with the instructions and you accept responsibility for any errors therein.

 

If Photographs Restored fails to perform clearly-requested instructions, Photographs Restored will re-work the image. Asking for a re-work about something that was not mentioned beforehand in the instructions, providing a new file to be restored, or asking to re-open a closed order may be estimated as "New Instructions" and have extra cost. We reserve the right to charge extra cost from the fourth and subsequent re-work requests. If order was estimated as "Retouch" or "Not Recommended" we reserve the right to charge extra cost from the second and subsequent re-work requests.

 

Photographs Restored will not refund an order unless unable to complete the work in accordance with the customer’s clear and complete instructions.

 

The determination whether Photographs Restored has complied with Customer instructions will be made by the CEO of the company and/or Quality Control personnel.

 

We are not required to refund, neither to perform for free or at any special price, orders that Customer failed to download during the time we stored restored files.

 

Photographs Restored is not required to refund orders that were estimated as "Severe", "Extreme", "Improvement" or "Basic", orders asked as "RUSH", orders that are unsatisfactory as a result of customer´s failure to include clear and complete instructions, orders that reached a third re-work request, by receiving a file smaller than 1800x1200 pixels, or by receiving a low resolution/pixelated/blurred/out of focus photo.

 

Privacy

 

Any kind of information given to us will only be used to identify you as a Client.

We will not trade with your personal data.

Our site does not focus on people under thirteen years old. Therefore, if we find information that has been sent by them, we will clear it out in order to protect your privacy on line. We also encourage parents to be active participants with their activities and interests on line.

Our site is in a trustworthy server and the data sending is made by SSL.
