Terms and Conditions

These Terms and Conditions govern your use of the Photographs Restored. By placing an order with us, you are stating your agreement to these Terms and Conditions, and a binding legal agreement is created. You should therefore read these Terms and Conditions carefully. You must be 18 years or older to use our services.

Legal obligations

Photographs Restored will not sell, rent or provide your personal information to any third-party, unless required to do so by judicial order, or in the event Photographs Restored reasonably determines that disclosure is essential to protect itself, its customers or third-parties from physical or financial harm that may result from unlawful or dangerous conduct.  
Photographs Restored makes reasonable efforts to handle customer images in a manner that avoids access to them or misuse of them by unauthorised parties.
Access to completed images is limited to our customers, Photographs Restored employees and affiliated creative services providers, and any third-party whose e-mail address the customer expressly provides.  
Photographs Restored will not use customer information for any purposes other than to process accepted orders.
In no event will Photographs Restored be liable to a client or any third party for any damages, including, but not limited to, service interruptions caused by Acts of God or any other circumstances beyond reasonable control, any lost profits, lost savings or other incidental, consequential, punitive or special damages (including lawyer's fees and court costs) arising out of the operation of the service.

Title to goods

Ownership of the goods shall not transfer to the purchaser until full payment has been received by Photographs Restored. In the unlikely event that an order is incorrectly completed, payment having been made, customers must contact us within five working days of receipt, providing full details of any discrepancy or error.

Any images or copies of images, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. Images are under the photographer's copyright and can only be reproduced with their permission. Illegal reproduction may result in legal action by the photographer. By submitting photographs to us for restoration, you affirm that no copyright is infringed. Photographs Restored will not be liable to you or any third party for such copyright infringement; even if that loss or damage was foreseeable by, or the possibility of it was brought to the attention of us. You will be liable for any copyright claims that arise.

Details of customers are kept in strict confidence and are not sold on to third parties. We value your privacy.

Photographs submitted by the customer remain the property and responsibility of the customer and are subject to the terms of the Freedom of Information Act.

Cancellation

If in the rare case a proof is rejected or otherwise cancelled, the client's liability will be limited to 50% of the total service cost including any retouching/painting fees, custom requests, or restoration charges. There will be no obligation to pay for extra printing or shipping costs. All monies will be refunded to the customer less 50% the service costs as described above. Refunds will not be given for completed work that has been approved.

Responsibilities

Photographs Restored shall not be held liable for any damage to photographs occurring while they are not in our possession. Secure carriage shall be the responsibility of the customer. Photographs Restored shall not be held responsible for loss or damage to photographs while in transit.

Images will be archived for 6 months in the event of a customer requiring further re-working.

Payment

Work shall not be started until written acceptance has been received of our estimate. Invoices shall be issue upon completion of work done. If an invoice remains unpaid after the stated invoice payment terms, Photographs Restored may consider legal action to obtain payment and the client will be liable for all legal expenses. All legal proceedings shall take place in the United Kingdom.

Photographs Restored reserves the right to refuse service for any reason.
